Presenting the OfferOnce the Offer is written, we immediately contact the listing agent to provide a copy of the written and signed OTP/C and any needed documents. At this point, there are options for presenting the Offer: either the listing agent presents the Offer to the Seller, or we (agents) may personally present the Offer to the Seller. As your agent, it is our right and privilege to personally present the Offer to the Seller, if you and we so decide it is appropriate. Offer Acceptance, Rejection, and Counter-OfferAs a buyer putting forward an Offer, you may state the specific means whereby the Seller may respond to your Offer. Also, anytime prior to a response of any kind by the Seller you may retract your offer. We will review these possibilities with you according to your needs. Once the OTP has been communicated to the Seller he/she and can do one of the following: Accept it, Reject it, or make a Counter-Offer. The first two possibilities are clear. The third option is essentially a rejection but indicates that the Seller wants to continue in negotiation. This means that the Seller has chosen to change one or more of the provisions in your offer or to add new provisions. This Counter OTP/C is normally communicated back to us and then to you for your consideration. You then have the same options as the Seller as when the Offer was initially presented. Another possibility in response to your offer, though rarely used, is receiving from the Seller a "Memo to Buyer". This is a memo from the Seller stating what type of Offer they would possibly entertain. While this does not represent a Counter Offer it does give a buyer information as to what might constitute an acceptable offer to make on a property. NegotiationComing to terms with a Seller on the purchase price and conditions in an Offer is sometimes relatively easy and sometimes very difficult. As your agent, we will represent you and your interests to the fullest in negotiations. Also, we will professionally manage the communication regarding terms between the Seller (usually via their agent) and you so that it is accurate and clear. Not all negotiations end in agreement; however, our primary purpose is to serve you and your interests. Offer Acceptance- ContractIt is important to note that any change in your Offer by the Seller represents a rejection of your original OTP/C, as does any change you might make in a Counter-Offer back to the Seller. In other words, Offer and Acceptance must mirror each other exactly in both written agreement and acceptance by both parties. We will discuss with you how an Offer becomes a contract through acceptance, what constitutes acceptance, and how and when acceptance occurs. |
