Working with Real Estate Agents

Joanne Parker and Associates understands that your decision to enter into an agency relationship with Joanne Parker and Associates and us is a matter of trust. We take seriously our professional, fiduciary responsibility to represent you. We respect all persons, and offer ourselves and our expertise without discrimination. We promise obedience to your lawful instructions, and loyalty to you in promoting and protecting your interests at all times. We promise to provide you with an accounting of the management and status of all monies (earnest monies, option monies, etc,) that are involved in the transaction.

Real estate agents in North Carolina are required per NC law to disclose agency to you through the NC Real Estate Commission (NCREC) brochure or printed document entitled, "Working with Real Estate Agents." This document outlines and specifies the types of agency (Seller's Agency, Buyer's Agency, Dual Agency) possible in N.C. that an agent may take on in their professional relationship with you. Importantly, it states what you can expect from your agent given the type of agency you might have with him/her. At first meeting or substantial contact, we will give this document to you, and review it with you. After reading it, you will be asked to sign it. This document is not a contract, nor is it a commitment to enter into an agency relationship.

The Listing Agreement

Listing agreements or contracts create an agency relationship. There are many options for listing your home which dictate the terms, duties and responsibilities that a seller’s agent may have with you, and the terms, duties and responsibilities you may have with a seller’s agent.They are:

  • Open Listing
  • Exclusive Agency Listing
  • Exclusive Right to Sell Listing

The most commonly used is the Exclusive Right to Sell Listing. The latter gives your agent the sole and exclusive right and authorization to represent you in the sale of your home. With this agreement you gain your real estate agent’s singular commitment and dedication to sell your home, along with his/her competency, knowledge, his/her marketing skills and outlets, and networking resources. For his/her labor on your behalf, the agent is entitled to be compensated by you. We will discuss with you what our mutual responsibilities are to each other during the listing period. We will be glad to discuss any of the listing options with you, and the provisions of each.
